terms of service

1. acceptance

By accessing or using KaijuSort (“the Service”), operated by BrownSun Group (“we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. the service

KaijuSort is a cloud-hosted digital asset management platform. We provide storage, organization, AI-powered tagging, and retrieval of media files you upload. The Service is provided “as is” and “as available.”

3. accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.

4. your content

You retain all ownership rights to files you upload (“Your Content”). We do not claim any intellectual property rights over Your Content. By uploading, you grant us a limited license to store, process, and display Your Content solely to operate the Service.

You represent that you have the right to upload all content and that Your Content does not violate any law or infringe any third-party rights.

5. ai tagging

The Service uses AI models to automatically generate descriptive tags for your media. These tags are best-effort and may be inaccurate. AI-generated tags are reversible — you can edit or remove them at any time. We do not use Your Content to train AI models.

6. storage, pricing & billing

Free accounts include a storage allowance as displayed at signup. Usage beyond the free tier requires a paid plan. We reserve the right to modify pricing with 30 days' notice. Files are stored at original quality and are never compressed.

Subscriptions & auto-renewal. Paid plans (Pro and Studio) are recurring subscriptions that automatically renew each month and charge your payment method on file until you cancel. One-time data top-ups are charged once and do not renew.

Cancellation. You can cancel your subscription at any time from the billing portal (Dashboard → Manage billing). Cancellation stops future renewals; your plan remains active until the end of the current billing period.

Refunds. Payments are generally non-refundable except where required by law. Billing is handled by our payment processor, Stripe.

7. prohibited use

You may not use the Service to: store or distribute illegal content; infringe on others' intellectual property; attempt to gain unauthorized access to the Service or other accounts; reverse-engineer, decompile, or disassemble any part of the Service; or use the Service for any purpose that violates applicable law.

8. termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, we will delete Your Content within 30 days unless legally required to retain it.

9. limitation of liability

To the maximum extent permitted by law, BrownSun Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. changes

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use after changes constitutes acceptance.
